Making Sense of Pennsylvania’s Workers’ Comp Disability Benefits
These benefits are designed to provide financial support to workers who, because of a job-related injury or illness, can’t return to their prior work or can’t earn the same wages. The amount and length of time you can receive benefits depend on the type and severity of your injury and what you were earning when you were hurt. One deadline matters immediately: you must report your injury to your employer within 120 days to remain eligible for disability benefits under the Pennsylvania Workers’ Compensation Act.
Pennsylvania workers’ compensation disability benefits generally fall into five categories:
- Temporary Partial Disability Benefits: If you can’t return to your regular job but can do lighter-duty work at lower pay, you may be entitled to temporary partial disability. This is typically two-thirds of the difference between your pre-injury wage and what you earn in the lighter-duty job.
- Permanent Partial Disability Benefits: If it’s medically determined that you have an ongoing partial disability, you may be entitled to two-thirds of the difference between your current and pre-injury wages. These benefits can continue for up to 500 weeks.
- Temporary Total Disability Benefits: If your injury is severe enough that you can’t work at all, you may be eligible for temporary total disability benefits. These are calculated based on your gross wages, known as your average weekly wage, up to a maximum set by the Pennsylvania Department of Labor & Industry.
- Permanent Total Disability Benefits: If it’s medically determined that your work-related condition may not improve, you may be considered permanently and totally disabled. Your compensation rate is based on your gross wages (average weekly wage), up to the maximum set by the Pennsylvania Department of Labor & Industry. If you’re also receiving Social Security benefits, your combined total from both sources can’t exceed 80% of your gross pre-injury average weekly wage.
- Specific Loss Benefits: These monetary benefits apply when a worker suffers an amputation or permanent loss of use of a body part, or a serious and permanent disfigurement of the head, neck, or face. They’re paid either weekly or in a lump sum, and the amount and number of weeks are set by the schedule established under Section 306(c) of the Pennsylvania Workers’ Compensation Act based on the body part involved.
