What First Responders in Pennsylvania Are Actually Entitled to

The standard workers' compensation system under the Pennsylvania Workers' Compensation Act provides two categories of benefits: indemnity (wage-loss) benefits and medical benefits. For most injured workers, that's the full picture. 

For first responders, it isn't.

The Pennsylvania Heart and Lung Act, formally the Enforcement Officer Disability Benefits Law, provides eligible police officers and firefighters with full salary continuation during a temporary line-of-duty disability, not just the two-thirds wage replacement that standard workers' comp provides. Medical benefits continue as well. The catch is timing: once an injury is classified as permanent, Heart and Lung Act eligibility ends, and the claim transitions to workers' compensation. Understanding which system to pursue, and when to make that transition, can directly affect a first responder's total recovery.

Pennsylvania Senate Bill 365, signed October 29, 2024, and effective October 29, 2025, changed the legal standard for first responder PTSD claims. Before this law, courts routinely denied psychological injury claims because claimants couldn't prove their trauma resulted from an abnormal working condition. SB 365 removes that requirement entirely. Instead, a first responder's post-traumatic stress injury must result from a qualifying traumatic event, defined as an incident resulting in serious bodily injury or death, involving a minor who has been injured, killed, abused, or exploited, involving an immediate threat to the life of the claimant or another, or responding to a crime scene for investigation. The diagnosis must be made by a licensed psychologist or psychiatrist. Benefits under SB 365 are capped at 104 weeks. The law covers EMS providers, active volunteer or paid members of a fire company who respond to emergency calls, Pennsylvania State Police officers, and peace officers who respond to emergency calls.
