Occupational Disease Claims near Allentown
35+ Years of Insight Into How Insurers Contest Work-Related Disease Claims
Occupational disease claims can be difficult because the connection between work and illness is not always visible from one event or one medical record. Symptoms may develop gradually, exposure may have occurred over years, and an insurance carrier may argue that the condition came from another cause.
Paula Robinson brings more than 35 years of Pennsylvania workers' compensation experience to these claims, including earlier work representing employers and insurance companies. That background helps her recognize how carriers challenge medical causation, workplace exposure, employment history, and disability evidence.
{Sub:BusinessName} now represents injured workers only. Clients work directly with Paula, not through a paralegal or case manager, and workers in the Allentown area can receive services in English or Spanish.

What Counts as an Occupational Disease in Pennsylvania?
Pennsylvania's Workers' Compensation Act identifies a number of specific occupational diseases and also contains a provision addressing certain diseases that are not individually listed.
Section 108 includes conditions such as certain forms of chemical poisoning, asbestosis, silicosis, anthraco-silicosis, and coal workers' pneumoconiosis when the statutory requirements are met.
For another disease to qualify under the general provision, the claim may need to establish that:
- The worker was exposed to the disease or its hazard because of employment
- The disease is causally related to the worker's industry or occupation
- The disease occurs substantially more often in that industry or occupation than in the general population
The medical diagnosis alone does not establish the workers' compensation claim. The evidence must also connect the disease to the worker's employment under the applicable legal standard.
Occupational hearing loss caused by long-term workplace noise is also addressed by Pennsylvania workers' compensation law, but it is governed by separate statutory provisions rather than the general occupational-disease category discussed here.
Exposure and Employment History Can Be Critical
Unlike a traumatic injury from a single accident, an occupational disease may result from repeated exposure over months or years.
Relevant workplace hazards can include asbestos, silica, coal dust, metals, chemicals, fumes, fibers, or other substances associated with the worker's occupation and diagnosed condition.
For certain diseases, Pennsylvania imposes additional employment-history requirements. Claims involving silicosis, anthraco-silicosis, coal workers' pneumoconiosis, or asbestosis generally require at least two years of aggregate Pennsylvania employment during the ten years preceding disability in an occupation involving the relevant hazard.
That makes the employment timeline an important part of the claim. Old job records, work locations, job duties, employers, and exposure periods may all matter when determining whether the statutory requirements can be established.
Pennsylvania's 300-Week Occupational Disease Rule
Occupational disease claims also have a rule that does not apply in the same way to ordinary traumatic injuries.
Pennsylvania generally requires the disability or death resulting from an occupational disease to occur within 300 weeks after the worker's last employment in an occupation or industry where the worker was exposed to the hazard of the disease.
Three hundred weeks is approximately five years and nine months.
This requirement is separate from the rules governing notice to the employer and the deadline for filing a claim petition. Long-latency diseases can therefore require careful review of the worker's last hazardous employment, onset of disability, medical diagnosis, and other dates.
Paula reviews that chronology before advising a client about available options.
Notice and Filing Deadlines Are Separate Issues
Workers should report a suspected work-related disease promptly.
Pennsylvania workers' compensation law generally requires notice to the employer within 120 days. When the nature of an injury or its possible relationship to employment was not known, the notice period may depend on when the worker knew or, through reasonable diligence, should have known of the injury and its possible relationship to work.
A separate deadline applies to a workers' compensation claim petition. In occupational disease cases, a petition generally must be filed within three years of the legally recognized injury or disability, subject to the rules that apply to the particular claim.
Because the 300-week requirement, notice period, and petition-filing deadline perform different legal functions, a worker should not assume that satisfying one automatically satisfies the others.
Building the Medical and Exposure Evidence
Causation is frequently the central dispute in an occupational disease claim.
An employer or insurance carrier may point to prior health conditions, smoking history, environmental exposures, previous employment, age, or the time between exposure and diagnosis as alternative explanations.
Evidence may include:
- Employment history: Employers, job titles, locations, duties, and dates
- Exposure evidence: Information identifying workplace chemicals, dust, fibers, fumes, or other hazards
- Medical evidence: Diagnostic testing, treatment records, occupational history, and qualified medical opinions
- Disability evidence: Documentation showing whether and how the disease affects the worker's ability to earn wages
- Workplace documentation: Safety records, industrial hygiene information, job descriptions, or other materials relevant to the alleged exposure
Paula's earlier experience representing employers and insurance carriers helps her anticipate how causation and exposure evidence may be challenged. She provides direct assessments of both the strengths and the difficulties in a claim rather than promising a particular outcome.
Workers' Compensation Benefits for a Work-Related Disease
When an occupational disease qualifies for Pennsylvania workers' compensation, available benefits can depend on the medical condition and its effect on the worker.
Potential benefits may include coverage for reasonable and necessary medical treatment related to the compensable condition and wage-loss compensation when disability reduces or eliminates earnings.
The firm's broader workers' compensation benefits practice also addresses disputed medical treatment, wage-loss benefits, denied claims, and other benefit issues that can arise during a case.
Since opening in 2011, {Sub:BusinessName} has recovered more than $22 million across its workers' compensation practice. Past results do not determine the outcome of a new claim.
